WHT under Sec.35(1)(c)

If you collect rent for a non-resident landlord, you're the one who must withhold — any person paying rent to a non-resident is the withholding agent. KRA

Finance Bill

Sharpens enforcement on foreign-landlord rent. The agent wears the audit risk. Kenyans.co.ke

The problem

Your agency has 200 doors, eight non-resident landlords, and an Excel sheet that won't survive an audit.

Every month, your team reconciles M-Pesa Paybill messages against tenant ledgers, computes withholding for diaspora landlords by hand, and emails owner statements that bounce because formatting broke in Excel. KRA just digitised the whole pipeline. You haven't.

M-Pesa reconciliation hell

Spending days matching M-Pesa transaction messages to specific tenants across multiple landlords' Paybills. Industry-acknowledged pain — see PMS.co.ke, Kayapro360, Nyumba Zetu marketing.

Sec.35(1)(c) audit risk

30% WHT on every non-resident landlord's rent. The AGENT is the statutory withholding agent — not the tenant. Andersen Kenya, CM Advocates, RSM Kenya all confirm.

Owner-statement chaos at scale

200 doors × 30 landlords × monthly statements = a part-time job for someone in your office. Errors propagate; trust erodes.

Caretaker accountability gap

On-the-ground vendors and caretakers report verbally. No photo trail, no GPS, no chain of custody on petty cash. Bomahut's own blog enumerates the fraud patterns.

The solution

What a back office actually has to do.

Everyone else ships a tool. Tenantree ships the back office: a multi-tenant ledger, a caretaker accountability layer, and an owner-payout system, wired together. Three jobs, done end to end.

01

Every payment matched.

Per-landlord rails on day one — M-Pesa Paybill auto-match in Kenya, Paystack and direct-bank on the roadmap. Read-only on money: your existing accounts never change hands. The reconciliation inbox closes itself.

02

Every site visit on the record.

Caretakers, inspectors, and vendors check in over WhatsApp — no app to install. Photo + GPS + timestamp on every visit, attached to the unit and the next owner statement. One-tap approval from the landlord. The evidence trail competitors don't ship.

03

Every owner paid right.

Multi-tenant ledger from day one — one agency, hundreds of landlords. Multi-currency owner statements with Stripe-style amend / void / re-issue. Magic-link portals so each owner sees their own roll-up. In Kenya: Sec.35 non-resident WHT done for you, iTax MRI export, eRITS-ready.

What only Tenantree does

Caretaker accountability,
on WhatsApp.

Reminders on WhatsApp are commodity — Bomahut, Kodi, Nyumba Zetu all do them. None of them give you photo + GPS proof of every caretaker visit, with one-tap approval. That's the moat.

  • 1 Caretaker texts INSPECT — no app to install.
  • 2 WhatsApp opens a checklist + photo picker + native location share.
  • 3 You see it land — with photo, GPS, timestamp — and tap Approve / Reject. From your sofa in Dubai or your shop in Westlands.

Built on Meta's official WhatsApp Cloud API. Free for tenants and caretakers — they just use the WhatsApp they already have.

Where we're starting

Five agencies. One square mile. Westlands, Nairobi.

We're beginning where the pain is sharpest: licensed Nairobi agencies already managing doors for owners abroad, already on the hook for the non-resident tax, already losing days to reconciliation. Win here first, then expand across the continent.

FAQ

For agency operators

Every existing KE option is built landlord-first — a single landlord with a handful of units. Tenantree's ledger, RBAC, and ownership-share machinery were built for agencies (one organisation, hundreds of landlord clients) from day one. We're the only agency-native option, and we're the only one with Sec.35(1)(c) WHT-NRL automation.
Nothing — that's the point. Your landlord clients keep their own Paybills; tenants pay them direct; the C2B Confirmation URL routes a webhook to Tenantree, which reads the transaction and matches it against the expected rent. Money never touches us. No CBK / FCA / SARS licensing question.
When a non-resident landlord is flagged in Settings, Tenantree auto-applies the 30% WHT rate (env-configurable for the Finance Bill 2026 change) to their tenants' rent. Each month you generate a CSV with per-property, per-currency totals, the tenant's KRA PIN, the agency's PIN, and the 20th-of-next-month deadline. Drop it into iTax. eRITS API integration is the next module.
They never download an app or create an account. WhatsApp Flows look like a normal interactive WhatsApp message. Photos, GPS, and structured checklists land in S3 with timestamps, attached to the unit and the next owner statement. If a caretaker won't engage even with WhatsApp, that signal itself is valuable.
30 minutes for the agency seat, ~5 minutes per landlord onboarding (KRA PIN, Paybill linkage, owner contact info), and tenants are imported via CSV. We'll sit with you for the first onboarding free.
Monthly, in Kenyan shillings. You pay for door capacity — Starter (≤100 doors) KES 4,000, Growth (≤300) KES 8,000, Scale (≤1,000) KES 15,000 — and every band includes the full toolkit. New agencies start with a 7-day free trial, then KES 1,000/mo for three months, then their band (founding members keep 25% off for a year). Compliance is an optional +KES 3,000/mo add-on.
We import from CSV (tenants, properties, owners) and run side-by-side for a billing cycle. Month-to-month — no lock-in. We'd rather lose a customer than trap one. Your historical price is grandfathered if we ever reprice.
